Conclusion of contract and ordering process

1. The presentation of the goods, in particular on the internet, does not constitute a binding offer by the seller.

2. By clicking on the "Add to cart" button, the selected items are placed in the shopping cart. At the end of the ordering process, a summary of the order and contract data will be displayed. Only after confirming this order and contract data by clicking on the button "order with obligation to pay" do you make a binding offer to purchase the goods in the shopping cart.

3. A contract is only concluded upon an order confirmation by the seller in text form.

Technical correction options

All entries made are displayed in a confirmation window before the order button is clicked and can be corrected by the customer before concluding the contract using the back button of the browser or the "change" button.

Contract language

The contract language is the language of the respective shop version (German, English, Spanish, Italian or French).

Storage of the contract text

The contract text is not stored by the seller. The customer can view the general terms and conditions on this page at any time. The order data, the withdrawal policy and the terms and conditions are sent to the customer by e-mail. After completion of the order, the contract text is no longer accessible to the customer via the internet.

Withdrawal

Consumers have a fourteen-day right of withdrawal. Please see the withdrawal policy for details.

You bear the direct costs of returning the goods.

Free return upon withdrawal: As a courtesy, in addition to the information in the withdrawal policy, we offer consumers the option of returning parcel goods at our expense. The prerequisite for this is the use of a return label provided by us, which the customer can request at hello@hellospain.de.

The right of withdrawal does not apply to the following contracts:

– contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer,
– contracts for the supply of goods that can spoil quickly or whose expiry date would quickly be exceeded,
– contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
– contracts for the supply of goods which, due to their nature, have been inseparably mixed with other goods after delivery.

Warranty

The buyer is entitled to the statutory warranty rights. Deviating provisions can be found in our terms and conditions.

Payment

You can pay by bank transfer, PayPal, credit card, Apple Pay and Google Pay.

If you select bank transfer as the payment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.

There are no additional costs for any of the payment methods.

Availability and delivery dates

Delivery takes place within the delivery period specified for the respective product during the ordering process.

In the event of delivery delays, the customer will be informed by the provider immediately after they become known. The provider is entitled to make partial deliveries and issue partial invoices at any time, provided this is reasonable for the customer. If partial deliveries are made by the provider, the provider bears the additional shipping costs.

If the provider is unable to ship an ordered product through no fault of its own because it has not been supplied by its suppliers despite their contractual obligation, or if performance is impossible for reasons of force majeure, the provider reserves the right not to deliver. In this case, the provider undertakes to inform the customer immediately about the unavailability of the ordered goods and to refund any payments already received from the customer without delay. Further claims of the customer do not exist.

Unless otherwise agreed, the goods are shipped to the delivery address specified by the customer. The customer is obliged to keep the delivery address data stored in their customer account up to date and to record every change in their customer account to ensure delivery.

For orders from customers residing or domiciled abroad, or where there are reasonable grounds to suspect a risk of payment default, the provider reserves the right to deliver only after receipt of the purchase price plus shipping costs (prepayment). If the provider makes use of the prepayment reservation, it will inform the customer immediately.

Prices and shipping costs

All prices quoted on the provider's website are shown in euros and include the applicable statutory VAT.

The shipping costs are stated in the order form before the order is sent and are to be borne by the customer.

Standard shipping: €7.90 per order. From an order value of €90 we deliver free of charge. Delivery within 3-6 working days: Austria, Belgium, Czechia, Denmark, France, Germany, Hungary, Italy, Luxembourg, Monaco, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain.

Shipping €19.90 per order, delivery within 5-9 working days: Bulgaria, Croatia, Estonia, Finland, Greece, Ireland, Latvia, Lithuania, Romania, Sweden.

Code of conduct

We have submitted to the following codes of conduct:

All German-language online shops are checked for compliance with the Trusted Shops quality criteria. The Trusted Shops quality criteria are based on the national and European laws relevant to online retail and take into account current case law as well as numerous demands of consumer protection associations. They protect the customers of the online shop from the typical risks of internet shopping.

Terms and Conditions

1. Contractual basis

1.1 All contracts concluded by the customer (consumer or entrepreneur) with the seller are based exclusively on these terms and conditions. The customer expressly acknowledges this with their order.

1.2 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.3 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business or profession.

1.4 We expressly point out that we do not ship our goods — including alcoholic beverages — to minors. By accepting our general terms and conditions, the buyer confirms that they are at least 18 years of age and have full legal capacity. In case of doubt, we reserve the right to request proof of age, which can be sent to us by post or e-mail.

2. Terms of delivery

If the seller incurs additional shipping costs due to the specification of an incorrect delivery address or an incorrect addressee, these costs shall be reimbursed by the customer, unless the customer is not responsible for the incorrect information.

3. Terms of payment

3.1 The purchase price is due immediately upon conclusion of the contract.

3.2 In the event of default in payment, the customer is obliged to pay the applicable statutory default interest.

3.3 Irrespective of 3.2, the seller remains free to prove higher damage caused by default as well as other damage.

4. Retention of title

The goods remain the property of the seller until full payment has been made.

5. Warranty

5.1 With regard to the warranty, the statutory provisions apply unless otherwise agreed in 5.2 - 5.3.

5.2 For consumers, the statutory warranty periods of their country apply. If the customer is an entrepreneur, the limitation period for claims for defects is 12 months from delivery of the item.

5.3 For merchants, the statutory examination and notification obligations under commercial law apply.

6. Right of withdrawal

6.1 The right of withdrawal applies exclusively to consumers.

6.2 The customer must package the goods appropriately for the return shipment, without prejudice to their right of withdrawal.

7. Limitation of liability

7.1 With the exception of injury to life, body and health and the breach of essential contractual obligations (cardinal obligations), the seller is liable only for damage attributable to intentional or grossly negligent conduct. This also applies to indirect consequential damage, in particular loss of profit. An essential contractual obligation is one whose fulfilment makes the proper execution of the contract possible in the first place and on whose observance the contractual partner regularly relies and may rely.

7.2 Except in cases of intentional or grossly negligent conduct or damage resulting from injury to life, body and health and the breach of essential contractual obligations (cardinal obligations), liability is limited to the damage typically foreseeable at the time of conclusion of the contract and otherwise to the average damage typical for the contract. This also applies to indirect consequential damage, in particular loss of profit.

7.3 The limitation of liability in paragraphs 1 and 2 applies mutatis mutandis in favour of the employees and vicarious agents of the seller.

7.4 Claims under product liability law remain unaffected.

8. Final provisions

8.1 The law of the Kingdom of Spain applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the customer has their habitual residence remain unaffected.

8.2 The place of performance is the registered office of the seller, provided the customer is a merchant.

8.3 If the customer is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in the country, the place of jurisdiction is the registered office of the seller (Córdoba, Spain).

8.4 Should individual provisions of this contract be invalid or contradict statutory provisions, this shall not affect the remainder of the contract.

9. Note on online dispute resolution

The EU Commission's platform for online dispute resolution (ODR platform) was discontinued on 20 July 2025. For complaints, please contact us directly at: hello@hellospain.de.

10. Note on consumer dispute resolution

We are in principle neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
